The Rockstar Service - Terms of Use & Membership Agreement

This document outlines the terms and conditions for both Homeowners/Users accessing our directory and Service Professionals subscribing to our membership. By accessing therockstarservice.com, you agree to these terms.

PART I: CONSUMER & VISITOR TERMS
(For Homeowners and General Users searching for services or financing)

1. Legal Disclaimer & Nature of Platform
The Rockstar Service™ is a technology platform and professional network connecting homeowners with independent service providers ("Members").

  • Not a General Contractor: We do not perform construction services, repairs, or installations.

  • Not a Financial Institution: We are not a licensed lender, loan broker, or bank.


2. Independent Contractors (Liability Release)

All services, estimates, and work are performed solely by the independent business listed on the Member Profile.

  • Verification: While we verify basic requirements (insurance/registration) at the time of onboarding, The Rockstar Service does not guarantee workmanship, project timelines, or outcomes.

  • Contracting: Any agreement entered into is strictly between the Homeowner and the Service Provider. The Rockstar Service is not a party to these contracts and is not liable for disputes, damages, or losses arising from these services.


3. Third-Party Financing

All financing options and "Apply for Loan" links connect directly to third-party lending partners (such as Round Sky or Enhancify).

  • No Credit Decisions: The Rockstar Service does not make credit decisions, issue loans, or handle funds for financing.

  • Subject to Approval: Approval, interest rates, and terms are determined solely by the lender based on your creditworthiness.


4. No Warranty

The "Rockstar Verified" badge indicates that a Member has met our network standards for documentation and professionalism at the time of verification. It is not a warranty of future performance or a guarantee of quality.

5. Third-Party Affiliation & Earnings Disclaimer

  • Not Facebook/Google: This site is not a part of the Google, YouTube, Bing, or Facebook website; Google Inc., Microsoft Inc., or Meta Inc. Additionally, this site is NOT endorsed by Google, YouTube, Bing, or Facebook in any way. GOOGLE and YOUTUBE are trademarks of GOOGLE, Inc. FACEBOOK is a trademark of FACEBOOK, Inc. BING is a trademark of MICROSOFT, Inc.

  • Earnings Disclaimer: We don't believe in get-rich-quick programs. We believe in hard work, adding value, and serving others. As stated by law, we can not and do not make any guarantees about your own ability to get results or earn any money with our ideas, information, programs, or strategies. Nothing on this page, any of our websites, or any of our content or curriculum is a promise or guarantee of results or future earnings, and we do not offer any legal, medical, tax or other professional advice.


PART II: MEMBERSHIP AGREEMENT
(For Contractors and Service Professionals subscribing to the platform)

6. Scope of Services & Membership

The Rockstar Service provides a Growth Infrastructure Platform for home service professionals. The specific components of your membership are determined by your selected tier.
Core Membership Includes:

  • Technology Integration: Access to third-party consumer financing tools integrated into a custom business profile.

  • Verified Authority Profile: Hosting and maintenance of your digital business profile.

  • Referral Engine: Access to our automated referral tracking system.


One-Time Setup: The initial "Setup Fee" covers the labor and materials required to build your custom profile, integrate banking links, and design/ship physical assets (such as Smart Business Cards).

7. Payment, Fees & Refund Policy

A. Membership Fees: Membership fees are billed on a month-to-month basis. Payments are processed automatically on the same day each month using the payment method on file.

B. Setup Fees (Non-Refundable): You understand that the Setup Fee covers the immediate custom build of your infrastructure and the printing/shipping of physical goods. This fee is strictly non-refundable once processing begins, as the work is performed immediately.

C. No Refunds Policy: ALL SALES ARE FINAL. There are NO REFUNDS on any payments made, including but not limited to Setup Fees, Monthly Membership Fees, Ad Spend, or Add-On purchases. By purchasing, you acknowledge that the nature of the service (digital setup, custom profiles, and marketing infrastructure) involves immediate labor and costs incurred by the Company.

D. Rate Lock Guarantee: If you subscribed under a "Founder Rate" or promotional price, this rate is locked for as long as your subscription remains active and in good standing. If you cancel and re-subscribe later, you will be subject to current market pricing.
8. Cancellation & Termination

A. Cancellation Policy: You may cancel your membership at any time. To cancel, you must contact your Account Manager directly or submit a request via our support portal.

B. Consequence of Cancellation: Upon cancellation or failure of payment, your access to the Platform is revoked immediately. This includes:

  • Deactivation of your Consumer Financing Link.

  • Removal of your Verified Authority Profile.

  • Suspension of the Referral System and forfeiture of any pending referral data.


C. Reactivation: Reactivating a cancelled account requires a Re-Onboarding Fee to rebuild the infrastructure and reactivate links.

9. User Eligibility & Strict Restrictions (Financing Applicants)
The financial matching services provided by this Site (for your customers) are subject to specific eligibility requirements established by our lending partners. By using this Site to request a loan, you represent and warrant that:

  • Age: You are at least 20 years of age and no older than 65 years of age.

  • Location: You are NOT a resident of the state of New York.

  • Employment: You are NOT a member of the Active Duty Military or a dependent thereof.

  • Banking: You have a valid Checking Account (Savings-only accounts are not accepted).

  • Accuracy: All registration information you submit will be true, accurate, current, and complete.


10. Third-Party Financing & Legal Disclaimer

A. Not a Bank: The Rockstar Service™ is a technology platform and marketing lead generator. We are NOT a bank, lender, loan broker, or financial institution. We do not make credit decisions, originate loans, hold consumer funds, or process loan payments.

B. Technology Integration: Our service provides integration to third-party financing platforms (such as Round Sky, Enhancify, or others). All loan approvals, terms, interest rates, and funding decisions are made solely by the third-party lenders.

C. No Guarantees of Funding: We do not guarantee that you (or your customers) will be matched with a lender, approved for a loan, or receive any specific interest rate. Approval depends entirely on the customer's creditworthiness and the lender's criteria.

D. Compensation: The Member acknowledges that The Rockstar Service may receive affiliate compensation or referral fees from third-party lenders for facilitating these connections.

11. Consent to Contact (TCPA)
By entering your telephone number and clicking "Submit," "Get Rates," or similar buttons on our Site, you provide your electronic signature and express written consent for us and our third-party lending partners to contact you for marketing purposes.
You agree to receive communications via:
 

  • Telephone calls (including to mobile numbers).

  • SMS and Text Messages.

  • Automated dialing systems and pre-recorded voice messages.


You agree to this contact even if your number is currently listed on any internal, corporate, state, or federal Do Not Call list. Consent is not a requirement to purchase goods or services.

12. Add-On Services (Ads & Leads)
If you purchase optional "Ad Boosts" or "Elite Growth" packages:
 

  • Ad Spend: Funds allocated for ad spend (Facebook/Google) are non-refundable once the campaign has launched, as this money is paid directly to the ad networks.

  • Lead Volume: While we strive to hit target lead volumes, specific results may vary based on market conditions, seasonality, and territory. We guarantee the work (creating ads/managing campaigns), not a specific number of sales.


13. Intellectual Property

  • Member Content: You retain ownership of your business logo, images, and customer data.

  • Platform Assets: The Rockstar Service retains ownership of the underlying code, profile designs, ad creatives, and video assets created by the Company. You are granted a license to use these assets only while your membership is active.


14. Limitation of Liability & Indemnification

A. Limitation of Liability: In no event shall The Rockstar Service, its directors, employees, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, lost revenue, or denied loan applications. Our total liability for any claim shall not exceed the total amount paid by the Member in the preceding one (1) month.

B. Indemnification: You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, arising out of your use of the Site or services.

15. Governing Law
This agreement shall be governed by the laws of the State of Colorado. Any disputes arising from this agreement shall be resolved through binding arbitration in Larimer County, Colorado.
